Tymeline Cloud is an India-based VPS and online infrastructure provider serving customers in India and internationally, subject to applicable local laws and our policies.

While we aim for accuracy, we do not warrant that all content is complete, current, or error-free. Product specifications, promotions, and prices may change without prior notice unless locked by a confirmed paid order.

You are responsible for ensuring that your use of hosting services complies with laws applicable to your business, industry, and jurisdiction (including data protection, consumer, export, and content laws).

4. Service availability & performance

We strive to deliver reliable uptime and performance. Hosting depends on networks, power, hardware, software, third-party providers, and the public internet. Except where expressly stated in a written service-level commitment for a specific plan, Services are provided on an “as available” basis. 5. Customer responsibility

You are solely responsible for content, applications, scripts, databases, and data you host or transmit through our Services.
You must maintain secure passwords, update software, and implement reasonable security practices for your websites and accounts.
You must keep valid contact and billing details and respond to abuse or security notices within stated timelines.
Backups: unless a plan expressly includes managed backups with defined retention, you remain responsible for independent backups of critical data.

6. Prohibited & unlawful use

You must not use our Services for any activity that violates Indian law or applicable international law, including the Information Technology Act, 2000 and rules framed thereunder. Prohibited activities include, without limitation:

Hosting or distributing malware, phishing pages, botnets, or tools intended for unauthorised access.
Fraud, identity theft, carding, scam pages, or payment gateway abuse.
Child sexual abuse material, trafficking, terrorism-related content, or other illegal content.
Copyright/trademark infringement, spam, open relays, or bulk unsolicited messaging.
Attacks on third-party systems, unauthorised network scanning, or cryptocurrency mining where prohibited by plan rules.

We may suspend or terminate Services, preserve logs, and cooperate with law-enforcement / CERT-In or other competent authorities when legally required or when necessary to protect our network and customers. Full rules: Acceptable Use Policy.

7. Payments, taxes & gateways

Online payments are processed through authorised payment gateways and banking partners (including Cashfree and UPI). Successful payment confirmation is required to activate or renew paid Services. Failed, reversed, or fraudulent transactions may result in suspension. Prices may be shown in INR and are subject to applicable GST or other taxes. Chargebacks initiated without contacting support first may be treated as a billing dispute and can lead to account review.

Refunds, if any, follow the refund policy published for the relevant product or as required by applicable consumer law / gateway settlement rules.

8. Third-party websites & software

Our site or Services may link to third-party websites, control panels, applications, scripts, or marketplaces. We do not control and are not responsible for third-party content, privacy practices, licensing, or security. Use of third-party software (including CMS plugins) is at your own risk.

9. Intellectual property

Tymeline Cloud Services branding, logos, website design, and documentation are protected by applicable intellectual property laws. You may not copy or misuse them without written permission. Customer content remains the customer’s property, subject to licences needed for us to host and deliver the Services.

10. Limitation of liability

To the maximum extent permitted by applicable law, Tymeline Cloud Services and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from use of (or inability to use) the website or Services—even if advised of the possibility of such damages.

Where liability cannot be excluded, our aggregate liability for a claim relating to Services shall not exceed the fees paid by you to Tymeline Cloud Services for the specific Service giving rise to the claim during the three (3) months preceding the event, unless a mandatory law requires otherwise.

11. Indemnity

You agree to indemnify and hold harmless Tymeline Cloud Services from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your misuse of Services, violation of law, or breach of our policies.

12. Governing law & jurisdiction

This Disclaimer and related disputes are governed by the laws of India. Subject to mandatory consumer protections, courts having jurisdiction over Kushinagar / competent courts in Uttar Pradesh, India shall have exclusive jurisdiction, without prejudice to our right to seek relief in any other appropriate forum for intellectual property or unpaid dues.

13. No waiver

Failure by Tymeline Cloud Services to enforce any provision of this Disclaimer does not constitute a waiver of that provision or any other right.

14. Updates

We may revise this Disclaimer periodically. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Services after changes constitutes acceptance where permitted by law.
